Radon Gas

Radon Gas is a naturally occurring radioactive gas that, when it has accumulated in a building in sufficient quantities, may present health risks to persons who are exposed over time. It is a colorless, odorless gas and has been found to be the second leading cause of lung cancer. Levels of radon that exceed federal and state guidelines have been found in buildings in Florida. Florida requires, as set forth by 404.056, that a Radon Disclosure statement be made:

Notification On Real Estate Documents:

Notification shall be provided on at least one document, form, or application executed at the time of, or prior to, a contract for sale and purchase of any building or execution of a rental agreement for any building. Such notification shall contain the following language:

“RADON GAS: Radon is a naturally occurring radioactive gas that, when it has accumulated in a building in sufficient quantities, may present health risks to persons who are exposed to it over time. Levels of radon that exceed federal and state guidelines have been found in buildings in Florida. Additional information regarding radon and radon testing may be obtained from your county health department.”

It is prudent to test for radon by a certified radon inspector. The results should be disclosed to the buyer and seller with a notification included in related real estate documents.
